End-User License Agreement (EULA) of

SRTStreamer

This End-User License Agreement ("EULA") is a legal agreement between you and GaraninApps (represented by Garanin Michael)

This EULA agreement governs your acquisition and use of our SRTStreamer software ("Software") directly from GaraninApps or indirectly through a GaraninApps authorized reseller or distributor (a "Reseller").

Please read this EULA agreement carefully before completing the installation process and using the SRTStreamer software. It provides a license to use the SRTStreamer software and contains warranty information and liability disclaimers.

If you register for a free trial of the SRTStreamer software, this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using the SRTStreamer software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Software supplied by GaraninApps herewith regardless of whether other software is referred to or described herein. The terms also apply to any GaraninApps updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

GaraninApps hereby grants you a personal, non-transferable, non-exclusive licence to use the SRTStreamer software on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the SRTStreamer software (for example a PC and laptop) under your control. You are responsible for ensuring your device meets the minimum requirements of the SRTStreamer software.

You are not permitted to:

Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
Sell the Software (because it's free)
Allow any third party to use the Software on behalf of or for the benefit of any third party
Use the Software in any way which breaches any applicable local, national or international law
Use the Software for any purpose that GaraninApps considers is a breach of this EULA agreement

Exception for third party parts of the Software

This agreement is not meant to change or supersede the terms of any open source or freesoftware license applicable to any portion of the Software. To the extent that the terms of anyopen source or free software license applicable to any portion of the Software conflict with thislicense, the terms of such open source or free software license shall prevail. Where required bythe applicable license, you may obtain a complete machine-readable copy of the source code forsuch free software without charge except for the cost of media, shipping, and handling, uponwritten request to GaraninApps. For example, some of our products are dynamically linked withan LGPL build of FFmpeg. FFmpeg is an open source library licensed under the LGPL version2.1. FFmpeg is a trademark of Fabrice Bellard, originator of the FFmpeg project. The sourcecodes of the currently used build are available in the "FFmpeg" folder in the Product'sinstallation directory. The open source software is distributed in the hope that it will be useful,but WITHOUT ANY WARRANTY, without even the implied warranty ofMERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.

Intellectual Property and Ownership

GaraninApps shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you.The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of GaraninApps.

GaraninApps reserves the right to grant licences to use the Software to third parties.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREETHAT YOUR USE OF THE PRODUCT IS AT YOUR SOLE RISK AND THAT THEPRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OFANY KIND FROM GARANINAPPS. YOUR USE OF THE PRODUCT AND ANYMATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THEPRODUCT IS AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELYRESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHERDEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH USE. GARANINAPPSFURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANYKIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THEIMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR APARTICULAR PURPOSE AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THATGaraninApps, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS SHALLNOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY FOR ANY DIRECT,INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGESTHAT MAY BE INCURRED BY YOU, INCLUDING ANY LOSS OF DATA, WHETHER ORNOT GARANINAPPS OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF ORSHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSESARISING. In no event shall GaraninApps total liability to you for all damages (other than as maybe required by applicable law in cases involving personal injury) exceed the amount of theLicense Fee paid under this License. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to GaraninApps.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
